Terms & Conditions
Please read these Terms carefully. They explain your rights and responsibilities when you use Parkwo as a driver or as a parking owner.
1. About these terms
- 1.1These Terms & Conditions (“Terms”) govern your use of the Parkwo website, mobile apps and related services (together, the “Platform”), operated by Parkwo Nepal (“Parkwo”, “we”, “us”).
- 1.2By creating an account, joining the waitlist, listing a space or making a booking, you agree to these Terms and to our Privacy Policy and Cancellation & Refund Policy. If you do not agree, do not use the Platform.
- 1.3Parkwo is a marketplace. We connect drivers looking for parking with people and businesses who have parking to offer. We do not own, operate or control the parking spaces listed on the Platform unless we say so clearly.
2. Definitions
- 2.1Driver: a user who searches for, books or uses a Parking Space.
- 2.2Owner: an individual or business that lists a Parking Space on the Platform, including operators and managers acting for an owner.
- 2.3Parking Space or Lot: any space, lot, driveway, basement, roadside or multi-storey area listed on the Platform.
- 2.4Booking: a confirmed reservation of a Parking Space for a specific vehicle type and time period.
- 2.5Fees: the parking charge set by the Owner plus any service fee shown at checkout.
- 2.6Vehicle: a 2-wheeler (bike, scooter, motorcycle), 4-wheeler (car, jeep, SUV) or electric vehicle (EV).
3. Eligibility and accounts
- 3.1You must be at least 16 years old to use the Platform, and at least 18 to list a Parking Space or make payments in your own name.
- 3.2You must give accurate, current information, including a valid Nepali mobile number, and keep it up to date.
- 3.3You are responsible for everything that happens under your account. Keep your login and one-time passwords (OTPs) private and tell us immediately if you suspect misuse.
- 3.4One person may hold only one account unless we agree otherwise. Business Owners may add staff accounts where the Platform allows it.
4. Bookings (for Drivers)
- 4.1A Booking gives you a licence to park one Vehicle of the booked type in the booked Lot for the booked period. It does not create a tenancy or give you any other rights to the property.
- 4.2Prices, availability, opening hours, facilities and access instructions are provided by the Owner and shown before you pay. Check them before confirming.
- 4.3Show your booking pass (QR code or booking ID) to lot staff when asked. Park only in the area you were directed to.
- 4.4If you stay longer than your Booking, extra time is charged at the Lot's displayed hourly rate. You can extend a Booking in the app while space is available.
- 4.5Availability shown on the Platform is provided in good faith and can change. If a Lot cannot accommodate your confirmed Booking, our Cancellation & Refund Policy applies.
5. Driver responsibilities
- 5.1Follow the Owner's rules, posted signs, traffic laws and any instructions from lot staff.
- 5.2Hold a valid licence, registration (bluebook) and any insurance required by Nepali law for the Vehicle you park.
- 5.3Do not leave valuables in your Vehicle. Lock it and take your keys unless the Lot operates a valet or key-handover service.
- 5.4Do not use a Parking Space for anything other than parking, such as storage, repairs, commercial activity or overnight stays, unless the listing allows it.
- 5.5Report any damage, incident or safety concern to the Owner and to us as soon as possible.
6. Listing a space (for Owners)
- 6.1You confirm that you own the Parking Space or have the legal right to rent it out, and that you hold any permits required by your ward or municipality.
- 6.2Keep your listing accurate and up to date, including capacity, vehicle types, pricing, hours, facilities and access instructions.
- 6.3Honour every confirmed Booking. Repeated cancellations, overbooking or refusing confirmed Drivers may lead to penalties or removal from the Platform.
- 6.4Keep the Lot reasonably safe, lit and accessible, and tell Drivers about any height, width or access restrictions.
- 6.5Parkwo may visit, photograph and verify your Lot before and after it goes live.
- 6.6Subscription plans (Public, Starter and Pro), their features and prices are shown on our website. Paid plans renew monthly until cancelled.
7. Fees, payments and payouts
- 7.1Drivers pay through the Platform using eSewa, Khalti or other methods we support. Prices are in Nepali Rupees (NPR) and include applicable taxes unless stated otherwise.
- 7.2Parkwo collects payments on behalf of Owners as a limited payment collection agent. Payment to Parkwo counts as payment to the Owner.
- 7.3Owner earnings, minus any agreed service fee or subscription charge, are paid out to the bank account the Owner registers, on the schedule shown in their dashboard.
- 7.4We never see or store your wallet PIN or password. Payments are processed by the payment provider under their own terms.
- 7.5We may correct pricing errors. If a Booking was made at an obviously wrong price, we may cancel it and refund you in full.
8. Cancellations and refunds
- 8.1Cancellations, no-shows and refunds are handled under our Cancellation & Refund Policy, which forms part of these Terms.
- 8.2Refunds are returned to the original payment method. Processing times depend on the payment provider.
9. Vehicles, property and liability
- 9.1Parkwo does not operate the Lots and is not a bailee or custodian of your Vehicle. Owners are responsible for their Lots, and Drivers park at their own risk.
- 9.2To the fullest extent permitted by Nepali law, Parkwo is not liable for theft of, loss of or damage to Vehicles or belongings, or for injury, while a Vehicle is parked. Claims should first be raised with the Owner. We will reasonably help with information we hold.
- 9.3Our total liability to you for any claim related to the Platform is limited to the Fees you paid for the Booking concerned, or NPR 5,000 if no Booking is involved.
- 9.4Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2075 or any liability that cannot be excluded by law.
10. Acceptable use
- 10.1Do not create fake bookings, listings, reviews or accounts, or impersonate anyone.
- 10.2Do not try to avoid Platform fees by arranging payment outside the Platform for a Booking found through Parkwo.
- 10.3Do not scrape, copy, reverse-engineer or overload the Platform, or interfere with its security.
- 10.4Do not use the Platform for anything unlawful, harmful or abusive towards other users or our staff.
11. Reviews and content
- 11.1Ratings and reviews must be honest and based on a real Booking. We may remove reviews that are fake, abusive or unrelated to the Lot.
- 11.2By posting content such as reviews, photos or listing details, you give Parkwo a non-exclusive, royalty-free licence to use it to operate and promote the Platform.
- 11.3The Parkwo name, logo, app and website are our intellectual property. You may not use them without our written permission.
12. Suspension and termination
- 12.1You can close your account at any time from the app or by emailing us. Confirmed Bookings and amounts owed remain payable.
- 12.2We may suspend or close accounts, remove listings or cancel Bookings if these Terms are breached, if we suspect fraud, or if we are required to by law.
13. Indemnity
- 13.1You agree to compensate Parkwo for losses, claims or costs, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Platform or, for Owners, the condition and operation of your Lot.
14. Changes to the Platform and these Terms
- 14.1We may update the Platform and change features, pricing or plans. Paid plan changes take effect from your next billing period.
- 14.2We may update these Terms. If a change is significant, we will notify you in the app or by email before it takes effect. Continuing to use the Platform means you accept the updated Terms.
15. Governing law and disputes
- 15.1These Terms are governed by the laws of Nepal.
- 15.2If you have a complaint, contact us first at info@parkwo.com. We aim to respond within 7 working days and resolve it within 30 days.
- 15.3If a dispute cannot be resolved informally, it falls under the jurisdiction of the courts of Kathmandu, Nepal.
